Fieldly, Inc. ("Fieldly," "we," "us," or "our") operates a home-services platform for routing, scheduling, and invoicing. - Location data: approximate location derived from IP address; precise GPS location if you grant permission in the mobile app.

2. How We Use Your Information
- Provide, operate, and improve the Services, including dispatching technicians and generating invoices.

- Send service updates, feature announcements, and promotional communications (where you have consented).

3. Legal Bases for Processing (GDPR / International Users)
Where applicable law requires a legal basis for processing personal data, we rely on:

4. SMS / Text Message Communications
- We use Twilio to deliver SMS messages. Your phone number is transmitted to Twilio solely for message delivery. Twilio's privacy policy is available at twilio.com/legal/privacy.
- We do not sell or share your phone number with third parties for their own marketing purposes.
- Opting out of SMS will not affect your ability to use the Services, but you may miss time-sensitive job notifications.
5. How We Share Your Information
We do not sell your personal information. We share data only as follows:
- Service providers: Twilio (SMS), payment processors, cloud hosting, analytics, and customer support tools — bound by confidentiality obligations.
- Field technicians / contractors: We share your name, address, and job details with the technician assigned to your service request.
- Business transfers: In connection with a merger, acquisition, or asset sale, subject to standard confidentiality protections.
- Legal compliance: When required by law, court order, or to protect the rights and safety of Fieldly, our users, or the public.
6. Cookies & Tracking Technologies
We use cookies, pixels, and similar technologies to maintain session state, remember preferences, and analyze traffic. You can control cookies through your browser settings. Disabling cookies may affect certain features of the Services.
7. Data Retention
We retain personal data for as long as your account is active or as needed to provide Services, resolve disputes, comply with legal obligations, and enforce agreements. Payment records are retained as required by tax and accounting law (typically 7 years).
8. Security
We implement commercially reasonable technical and organizational measures to protect your information, including TLS encryption in transit and AES-256 encryption at rest. No method of transmission over the internet is 100% secure; we cannot guarantee absolute security.
9. Your Rights & Choices
Depending on your jurisdiction, you may have the right to:
- Access the personal data we hold about you.
- Correct inaccurate data.
- Request deletion of your data (subject to legal retention requirements).
- Opt out of marketing communications at any time via the unsubscribe link or by replying STOP to SMS.
- Lodge a complaint with your local data protection authority (EU/UK residents).
- Under the California Consumer Privacy Act (CCPA), California residents have additional rights to know, delete, and opt out of the sale of personal information. We do not sell personal information.

Terms of Use
These Terms of Use ("Terms") govern your access to and use of Fieldly, Inc.'s website, platform, mobile application, and related services (collectively, the "Services"). Please read them carefully.
1. About Fieldly
Fieldly provides a software platform that enables home-service businesses to manage field operations, including job routing, technician scheduling, dispatch, customer communication, and invoicing. Fieldly is a technology platform — we do not directly perform home-service work.
2. Eligibility
- You must be at least 18 years old to create an account.
- By using the Services, you represent that you have the legal authority to enter into these Terms on behalf of yourself or your business entity.
- The Services are available only in jurisdictions where they are legally permitted.
3. Account Registration & Security
- You must provide accurate, complete, and current information when registering.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Notify us immediately at support@gofieldly.com if you suspect unauthorized access.
- We reserve the right to suspend or terminate accounts that violate these Terms or our policies.
4. SMS & Electronic Communications
- SMS messaging is provided via Twilio. By consenting to SMS, you acknowledge that messages are transmitted through Twilio's infrastructure and are subject to Twilio's Acceptable Use Policy.
- You represent that you are the account holder or have authorization from the account holder for the phone number provided.
- Fieldly is not liable for delays in SMS delivery caused by carrier networks or technical issues outside our control.
- Opting out of SMS is your right and will not result in denial of Services, though you may not receive real-time job notifications.
5. Payments & Billing
- All fees for using Fieldly's platform are described in your applicable subscription or service agreement.
- Payments are processed by our third-party payment processor. By submitting payment information, you authorize us and our payment processor to charge the applicable fees.
- Invoices generated through Fieldly on behalf of a service business to their customers are solely between the service business and the end customer. Fieldly is not a party to those transactions and is not responsible for disputes between service businesses and their customers.
- All fees are non-refundable unless otherwise stated in your plan agreement or required by applicable law.
- We reserve the right to change our pricing with reasonable notice to existing subscribers.
6. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable regulations.
- Send spam, unsolicited commercial messages, or messages to individuals who have opted out.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Reverse-engineer, decompile, or attempt to extract source code from the platform.
- Use automated tools (bots, scrapers) to access the Services in ways that could damage, disable, or impair the platform.
- Transmit any viruses, malware, or other harmful code.
- Use the Services to harass, threaten, or harm any person.
- Circumvent or attempt to bypass any security measures or access controls.
7. Intellectual Property
All content, features, and functionality of the Services — including software, text, graphics, logos, and trademarks — are owned by Fieldly or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services solely as described in these Terms. No license to Fieldly's intellectual property is granted beyond this limited use.
8. Third-Party Services
The Services integrate with third-party services including Twilio (SMS), payment processors, and mapping/routing providers. These integrations are subject to the respective third parties' terms and privacy policies. Fieldly is not responsible for the practices of third-party providers. Your use of third-party services through Fieldly may be subject to additional terms.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FIELDLY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIELDLY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL FIELDLY'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO FIELDLY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnification
You agree to defend, indemnify, and hold harmless Fieldly and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) your communications with end customers through the platform.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of [Your State], without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services that cannot be resolved informally shall be submitted to binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to participate in a class-action lawsuit or class-wide arbitration.
13. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website with a new effective date, and — for significant changes — by email or in-app notification. Your continued use of the Services after the effective date constitutes your acceptance of the revised Terms.
14. Termination
We may suspend or terminate your access to the Services at any time for violation of these Terms or for any other reason, with or without notice. Upon termination, all licenses granted to you will cease. Sections 7, 9, 10, 11, and 12 survive termination.
15. Miscellaneous
- Entire Agreement: These Terms, together with the Privacy Policy and any applicable subscription agreement, constitute the entire agreement between you and Fieldly.
- Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
- Waiver: Failure to enforce any provision shall not constitute a waiver of our right to enforce it in the future.
- Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely.
